This website is operated by Nitestore. The terms “we”, “us”, and “our” refer to Nitestore. By accessing our site and/or purchasing from us, you agree to be bound by these Terms of Service. They apply to all users of the site.

1. Eligibility

To use this website or purchase from Nitestore, you must be at least the age of majority in your country or region. If under the age of majority, parental or guardian consent is required.

2. Products & Services

2.1 Digital Products — Sample Packs, Ableton Templates, Presets & Downloads

All digital products are non-refundable and licensed for individual, non-transferable use only. Redistribution, resale, sublicensing, or public release in any form is strictly prohibited. By purchasing, you receive a non-exclusive licence for personal or commercial music production use. Creators selling on our platform confirm they own or have cleared all rights to their content. Nitestore operates in good faith and is indemnified against all claims arising from creator-submitted content.

2.2 Services — Feedback, Stem Mixdown & Digital Mastering

All track services are non-refundable. Feedback is subjective and provided as professional opinion in good faith. Completed files are delivered digitally and are not transferable.

2.3 One-to-One Lessons (Live)

Lessons are delivered live via video call and are not recorded. One week’s notice is required to reschedule. No-shows and late cancellations are non-refundable.

2.4 Custom-Made Clothing

All clothing is made to order. Returns and refunds are not accepted. Please check sizes carefully before purchasing.

2.5 Nitestore Studio — Membership & Subscription

A Nitestore Studio subscription grants access to a private members-only area containing tutorials, tools, and exclusive content.

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period. Subscriptions can be cancelled at any time via your account at nitestore.xyz/account or through your device’s account settings if purchased via a mobile app store.

Membership is personal and non-transferable. Sharing credentials or redistributing content is strictly prohibited and monitored. Violations result in immediate termination without refund. Nitestore reserves the right to pursue legal action for copyright infringement or breach of contract.

2.6 Subtitles & Translations

Content within Nitestore Studio may include subtitles or translations for accessibility. Nitestore does not guarantee accuracy. The original language version always takes precedence. Translation inaccuracies are not grounds for refunds or compensation.

2.7 Vinyl Records — Nitecutz

Unauthorised copying, redistribution, or digital reproduction of vinyl content is strictly prohibited. All intellectual property rights remain with Nitecutz and/or the respective rights holders. Purchasing does not grant any licence to reproduce or distribute recordings.

2.8 Track Premiere

Submitting your track for premiere constitutes permission for Nitestore to feature and promote it across its platforms for that purpose. This does not transfer ownership of your music. Nitestore reserves the right to decline any submission.

2.9 Nitestore Gate — Audience Building Tool

Nitestore Gate allows users to create gated content links that collect email addresses and other actions from visitors in exchange for access to a file or URL.

Data responsibility: You are the data controller for all personal data collected through gates you create. Nitestore acts as a data processor on your behalf. You are solely responsible for ensuring your use of Nitestore Gate complies with all applicable data protection laws, including the UK GDPR, EU GDPR, and any other applicable regulations.

Consent: You must ensure visitors to your gates are properly informed about how their data will be used and that appropriate consent is obtained where required by law.

Data ownership: Email addresses and other data collected through your gates belong to you. Nitestore does not sell or share this data with third parties except as required to provide the service.

Content responsibility: You are solely responsible for the content you gate. Nitestore does not review gated content and accepts no liability for it. We reserve the right to remove any gate and terminate any account that violates these Terms or applicable law.

Prohibited uses: Nitestore Gate must not be used to collect data deceptively, distribute unlawful or harmful content, infringe third-party rights, send unsolicited communications, or violate any applicable laws. Violations will result in immediate account termination without refund.

2.10 Community

By participating in the Nitestore community, you grant Nitestore a non-exclusive licence to display your content on the platform. You retain ownership of your posts. Nitestore reserves the right to remove content and terminate accounts that violate community guidelines, these Terms, or applicable law. You are responsible for ensuring your posts do not infringe third-party rights or contain unlawful content.

2.11 Music Submissions

Submitting music does not create any obligation on Nitestore to respond, release, or feature it. You retain ownership of all submitted music. By submitting, you confirm you own or have cleared all rights to the material. Nitestore will not use submitted music commercially without your explicit written consent.

3. Returns & Refunds

All sales are final. We do not accept returns or issue refunds due to the digital and custom nature of our products and services.

4. Payment & Billing

You agree to provide accurate billing information. We reserve the right to refuse or cancel orders that appear fraudulent. Initiating a chargeback without first contacting us may result in account suspension.

5. Intellectual Property

All content on this site — including the trademarks “Nitestore”, “Niteplan”, and “Nitecutz”, as well as sample packs, tutorials, branding, graphics, and media — is the intellectual property of Nitestore and/or its content creators. Nothing on this site grants any licence to reproduce, distribute, sell, or exploit our intellectual property without express written permission.

6. Access & Download Issues

If you experience problems accessing digital products or membership content, contact support@nitestore.xyz and we will make reasonable efforts to resolve the issue.

7. User Conduct

You agree not to use the site for unlawful purposes, transmit malicious code, infringe intellectual property, misuse other users’ data, share account credentials, or distribute private content. We reserve the right to terminate accounts in breach of these Terms without notice.

8. Limitation of Liability

Nitestore is not liable for any direct, indirect, incidental, consequential, or special damages arising from use of our site, products, or services. All products and services are provided “as is” without warranty except where explicitly stated.

9. Indemnification

You agree to indemnify and hold harmless Nitestore and its affiliates, officers, staff, and partners from any claims, damages, or legal expenses arising from your breach of these Terms or misuse of our services.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

11. Modifications

We reserve the right to update these Terms at any time. Updates will be posted on this page. Continued use of the site constitutes acceptance of the revised Terms.
